The petition coming on for hearing, upon perusing the petition and the grounds filed herein and upon hearing the arguments of Sri M.Achuta Reddy, Advocate for the Petitioners and of the Addl. Public Prosecutor for the Respondent, the Court made the following. ORDER:
"This criminal petition is filed by the petitioners-A2 to A5 under Section 438 of the Criminal Procedure Code seeking anticipatory bail in Crime No.233 of 2013 of Balanagar Police Station, Mahabubnagar District, registered for the offence punishable under Section 498-A of IPC.
2. Heard the learned counsel appearing for the petitioners - A2 to A5 and the learned Additional Public Prosecutor representing the respondent-State.
3. The de facto complainant, who was working as MPH,
ANM developed physical contact with the first accused and became pregnant. According to her, the first accused promised her to marry but subsequently refused to marry her. The allegation against the petitioners - A2 to A5 is that they are forcing the first accused not to marry the de facto complainant by saying that she became pregnant by some other person. I do not see any active involvement of the petitioners - A2 to A5 in the commission of offence alleged. Therefore, I am inclined to grant anticipatory bail to petitioners - A2 to A5.
4. In the result, the Criminal Petition is allowed and the petitioners-A2 to A5 are therefore directed to surrender before the Station House Officer, Balanagar Police Station, Mahabubnagar District, within twenty days from today and thereafter, they shall be released on bail on their executing personal bonds for a sum of Rs.10,000/-(Rupees ten thousand only) each with two sureties for the like sum each to the satisfaction of the said SHO."
