This Writ Petition is filed by the petitioner seeking the following relief pleased to rssue appropriate writ order or direction more particularly one rn the nature of Mandamus declaring the actron of the 2nd respondent in not accepting the disability certifrcate issued by the Medical Superintendent Government Area Hospital C788 Sachivalaya Nagar Vanasthalipuram Ranga Reddy Distrtct on the ground that the case of the petitioner diagnosed decease Heamophilta not covers under their rules is illegal arbitraryand contrary to the provisions of the The Rtghts of Persons Disabilities Act 2016 and consequently direct the respondents 2 and 3 to take into consideration of the disability certrficate of the petitioner Dt 15 04 2025 and provide the seat in the College through Counselling in pursuance of the TG EAPCET 2026 schedule and as per the Notification Dt 08 06 2026 of the 2nd respondent and pass. .. "
02. Heard Sri Ramulu Pasupula, learned counsel for the petitioner, Sri K.Sharath, learned Assistant Government Pleadet appearing for respondent Nos.'1 and 2 and Sri A.P.Suresh Ram,
learned Standing Counsel appearing for respondent No.3 Perused the record 03(a). Learned counsel for the petitioner submitted that pursuant to the TGEAPCET-2026 notification the petitioner uploaded all the requisite certificates, including the disability certificate dated 15.04.2025 issued by the Medical Superintendent, Government Area Hospital C788, Sachivalaya Nagar, Vanasthalipuram, Ranga Reddy District. After the Hall Ticket was issued, the petitioner appeared for the T GEAPCET-2026 examination and secured Rank No 69,338 03(b). Learned counsel further submitted that respondent No.2, vide notification dated 08.06.2026, issued the schedule for conducting the TGEAPCET -2026 counselling As per the sard notification, reservation for Persons with Disabilities is governed by G.O Ms.No.2, Higher Education (TE) Department, dated 28 01 .
2025, which earmarks 5% reservation for eligible candidates Pursuant thereto, the petitioner attended the counselling on 29 06.2026. However, to his surprise. respondent No.
03(c). Learned counsel for the petitioner further submitted that the petitioner approached the Commissioner for RigMs of Persons with Disabilities, Telangana, by submitting a representation, Upon consideration of the same, the Commissioner issued a letter dated 30 06.2026 to respondent No,3 stating that, in terms of Section 32 of the Rights of Persons with Disabilities Act, 20'16, Government institutions shall reserve 5% of seats for persons with benchmark disabilitres. Despite receipt of the said communication, respondent Nos.2 and 3 failed to consider the petitioner's disability certificate. Therefore. learned counsel prayed that respondent Nos.2 and 3 be directed to permit the petitioner to participate in the TGEAPCET2026 counselling pursuant to the notification dated 08 06.
2026 by taking into consideration the disability certificate dated 15.04.2025.
05. Having heard the learned counsel for the parties and upon perusal of the material available on record, this Court finds that
the petitioner possesses a disability certificate certifying 40% disability. ln view of the same. respondent Nos.2 pnd 3 are directed to consider the petitioner's disability certificate dated 15.042025 and provide a seat to the petitioner, if he satisfies other requirements pursuant to the notification dated 0g.06.2026. in accordance with law.
Accordingly, with the directions, this Writ petition is disposed of. There shall be no order as to costs.
As a sequel, the miscellaneous applications. jf any, shall stand closed SD'. T.
