THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.26390 of 2009 ORDER:

Heard the learned Counsel for the petitioner and the learned Government Pleader for the respondents.

This writ petition is filed declaring the action of the respondents in keeping the police personnel in and around the petitioner's club premises bearing Nos.1-2-605/A/1 and A/7 to A16, Lower Tank Bund, Hyderabad, and illegally arresting the members of the club and guests, harassing and detaining them in the police station through out night on 26-11-2009 under the guise of registering a crime under Sections 3 and 4 of the Gaming Act, and putting the seals again to petitioners premises by violating the orders passed by this Court as illegal and arbitrary. This Court, by order dated 08.12.2009 directed the respondents to handover the vacant possession of the club premises to the petitioner. But, however, it was further ordered that if it is within the knowledge of the respondents that the petitioner is indulging in illegal activities, they may search the petitioner club in accordance with Section 100 Cr.P.C. In view of the said interim order, no further orders are necessary in the present Writ Petition and the same is accordingly closed.

The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
