The present writ petition is filed to declare the action of the respondent Nos.3 & 4 in not registering the First Information Report, in pursuance to the complaint of the petitioner dated 26.11.2019, as being illegal, arbitrary and in violation of fundamental rights.
Heard Ms. Vanga Anita, learned counsel for the petitioner and the learned Assistant Government Pleader for Home appearing for the respondents.
The learned Assistant Government Pleader for Home, on written instructions dated 30.12.2019, submits that one G. Rajani, who is the petitioner in the present writ petition, has sent a complaint through registered post to the 4th respondent-Station House Officer, Chandanagar Police Station, which was received on 27.12.2019.
It is stated by the learned Assistant Government Pleader that on receipt of the above complaint, a case was registered in Crime of No.708 of 2019 of Chandangar Police Station on 27.12.2019 for the offences punishable under Sections 341 and 506 of the Indian Penal Code, 1860.
Having regard to the said submission made on behalf of the official respondents, since a case is already registered based on the compliant of the petitioner, the grievance of the
petitioner in the present writ petition stands redressed and no furthers orders are required to be passed.
Accordingly, the writ petition is closed. However, there shall be no order as to costs.
