THE HON'BLE SRI JUSTICE L. NARASIMHA REDDY CONTEMPT CASE No.1517 of 2012 ORDER :

The petitioners and five others filed W.P.No.16812 of 2010, seeking directions to the respondents, to engage them on daily wage basis. In W.P.M.P.No.21187 of 2010 in the writ petition, this Court passed an interim order on 07.10.2010, directing that if there is work, which can be done by daily wagers, it is open to the respondent employer to employ the writ petitioners, either on temporary basis, or on daily wage basis, instead of engaging fresh candidates. However, it was clarified that no right whatsoever would accrue to the writ petitioners, on account of such engagement. This Contempt Case is filed, alleging that the respondents did not engage them, though there exists adequate work.

The 4th respondent filed a counter affidavit. He furnished particulars of the vacancies in the Srisailam Project, as well as the particulars of correspondence that ensued in this behalf. At one place of the counter affidavit, he tried to malign one of the petitioners, by stating that the particulars furnished by her are fabricated ones. At a later point of time, he filed an affidavit, with a prayer to delete that portion in the counter affidavit and tender unconditional apology for stating such facts. Heard the learned counsel for the petitioners and the learned Government Pleader for Irrigation.

The direction issued by this Court in W.P.M.P.No.21187 of 2010 was not in specific terms. It is to the effect that in case there exists any workload, the respondents shall engage the petitioners. The particulars of workload are furnished in the counter affidavit. If the

petitioners are so advised, they can file a fresh W.P.M.P. for necessary directions in this behalf.
