ORDER:

This writ petition is filed with the grievance that the respondents have not been paying the rents to the building bearing municipal No.16-11-69/70 of Musarambagh, Hyderabad which was taken on lease for running Government BC Girls College Hostel. At the hearing, there is no representation for the petitioner. The learned Government Pleader for Social Welfare, on instructions, submitted that the rent for the above-mentioned building is due from 21.01.2009 to 22.12.2009 at Rs.5/- per sft., and from 23.12.2009 to 08.10.2010 at Rs.10/- per sft. He further submitted that the only reason for not paying the rent is non-production of the original sale deed by the petitioner. The learned Government Pleader, however, conceded that the Deputy Director of Backward Classes, Social Welfare Department has entered into a lease agreement with the petitioner recognising her as the owner.

Therefore, purported non-production of sale deed by the petitioner cannot be made a ground for withholding the rent. If the petitioner is unable to produce the original sale deed, respondent No.3 shall obtain indemnity bond from her and make payment of the admitted arrears of rent, within a period of one month from the date of receipt of a copy of this order.

Subject to the above direction, the writ petition is disposed of. As a sequel to disposal of the writ petition, W.P.M.P.No.42472 of 2013 shall stand disposed of as infructuous. C.V.NAGARJUNA REDDY, J 31st December, 2013 VGB
