I.A.No.2 of 2018 is filed under Section 5 of the Limitation Act to condone the delay of 404 days in resubmitting the Criminal Appeal. 2.

This Court, vide order, dated 07-09-2018 permitted the petitioner to take out notice to the respondents by RPAD and file proof of service within 3 weeks. The petitioner has not filed any proof of service and there is no representation on behalf of the petitioner.

Therefore, I.A.No.2 of 2018 is dismissed and consequently, Criminal Appeal is rejected.
