THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.13741 of 2015 ORDER:
This Criminal Petition is filed by the petitioner-accused No.2 under Section 438 Cr.P.C. seeking anticipatory bail in CC No.593 of 2011 on the file of IX Additional Chief Metropolitan Magistrate, Hyderabad, arising out of Crime No.183 of 2011 of Narayanagua P.S., Hydedrabad, for the offence punishable under Section 382 IPC. Heard and perused the material available on record. The allegation against the petitioner is that he was involved in chain snatching cases.
Learned counsel for the petitioner submitted that the petitioner was arrested in similar cases and after due trial, sentence was imposed against him and after completion of the sentence, he was released from the jail. He further submitted that in the present case charge sheet was already filed and since the petitioner failed to appear before the Court, NBWs were issued against him. Considering the above facts and circumstances of the case, this Court is inclined to pass the following order: The petitioner is directed to approach the Court concerned and file an application to recall the warrant and on filing of such application, the Court concerned is directed to recall the same on the same day on petitioner executing a personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) with one surety for the like sum. Further, the petitioner is directed to appear before the Court concerned regularly on all hearing dates.
