N.Charyulu COUNSEL FOR THE RESPONDENT : The Additional Public Prosecutor Petition under Section 438 of Cr.P.C., praying that in the circumstances stated in the petition and grounds filed herein, the High Court may be pleased to grant anticipatory bail to the petitioners with a direction to release them on bail in the event of their arrest relating to the Crime No. 120 of 2012, dated 20.10.2012 on the file of the P.S. Chennaraopet, Warangal District.

ORDER:

"This criminal petition is filed by the petitioners-accused under Section 438 of the Criminal Procedure Code seeking anticipatory bail in Crime No.120 of 2012 of Chennaraopet Police Station, Warangal District, registered for the offence punishable under Sections 420, 468 and 471 of IPC.

Heard the learned counsel appearing for the petitioners - accused 3 to 6, 8 to 10, 13, 16 to 20 and the learned Additional Public Prosecutor representing the respondent-state.

3. It is alleged against the petitioners and several other agriculturists that they obtained loans by producing false pattadar passbooks and title deeds. Learned counsel appearing for the petitioners submits that the revenue officials processed the loan applications and the petitioners by themselves did not produce any documents for the purpose of obtaining loans issued by the revenue authorities. The learned counsel would submit that the petitioners have repaid the loans borrowed by them. In view of the above, I am inclined to grant anticipatory bail to the petitioners.

In the result, the Criminal Petition is allowed and the petitioners -A3 to A6, A8 to A10, A13, A16 to A20 are therefore directed to surrender before the Station House Officer, Chennaraopet Police Station, Warangal District, within twenty days from today and thereafter, they shall be released on bail on their executing personal bonds for a sum of Rs.10,000/-(Rupees ten thousand only) each with two sureties for the like sum each to the satisfaction of the said SHO. "
