HON'BLE SRI JUSTICE R. KANTHA RAO W.P.No.40664 of 2014 ORDER:

This Writ Petition is filed seeking to declare the proceedings dated 18.12.2014 issued by the 2nd respondent as arbitrary and illegal.

Initially, the petitioner was appointed as Work Inspector on 1.6.1992 in the District Scheduled Castes Service Co-operation Society, Guntur District, on consolidated pay.

Thereafter, his services were regularized and he was promoted as Assistant Engineer on 11.3.2006. While so, he was kept under suspension on the allegation of committing certain irregularities and misappropriation of funds based on a complaint against him lodged by the SC/ST/BC Welfare Association, Guntur, with regard to execution of work relating to construction of compound wall. The Deputy Executive Engineer, Quality Control Sub Division, Guntur, inspected the works executed by the petitioner and submitted his remarks stating that the construction of compound wall in APSWRS Complex, Ramakrishnapuram (V), Sattenapalli Mandal, Guntur District, was completed satisfactorily.

Thereafter, enquiry was ordered and the petitioner was issued with a charge memo dated 18.12.2014, for which he

submitted his detailed explanation stating that there is no deviation of procedure or approved work and moreover no repetition of work was done at any stage. The grievance of the petitioner is that in spite of the remarks submitted by the Deputy Executive Engineer that the work was completed satisfactorily, he was placed under suspension illegally.

Under these circumstances, the respondents are directed to complete the enquiry initiated against the petitioner and pass appropriate orders thereon within a period of three weeks from the date of receipt of a copy of this order. However, it is made clear that if the enquiry is not completed within the stipulated period, the petitioner shall be reinstated into service.

Accordingly, the writ petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
