M.K. Viswanatham v. The State Of Andhra Pradesh,
HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.44717 of 2017 ORDER:
Heard Mr.K.Venkatesh for petitioner and the Assistant Government Pleader (Tribal Welfare) for respondents. On 06.12.2017, the petitioner filed revision under Section 6 of the A.P. Scheduled Areas Land Transfer Regulation 1 of 1959 against the order dated 14.11.2017 in C.M.A.No.112 of 2008, but the 1st respondent did not take up the application filed for stay or given a date for arguing the revision. While the matter stood thus, respondents 3 to 5 are forcibly evicting the petitioner. According to Mr.Venktesh, if the petitioner is dispossessed pending consideration and disposal of revision, the petitioner will be put to loss and hardship. Hence, the writ petition. The revision filed against order dated 14.11.2017 in C.M.A.No.112 of 2008 is pending before the 1st respondent. Therefore, if the petitioner is dispossessed pending revision, the petitioner suffers loss and hardship.
Hence, the writ petition is disposed of by this order. (a) The 1st respondent considers taking up application filed for stay and passes orders as expeditiously as possible, preferably within three months from the date of receipt of a copy of this order.
(b) The parties are directed to maintain status-quo as regards possession as on date till a decision is taken and communicated by the 1st respondent.
Miscellaneous petitions, if any, pending, shall stand closed. No order as to costs.
