HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.44787 of 2017 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner with an innocuous prayer seeking to direct the respondents 2 to 4 to consider the application of the petitioner, dated 08.03.2017, for grant of quarry lease for Road Metal and Building Stone in S.No.6 Part of Palempalle Village, Punganur Mandal, Chittoor District, to an extent of 2.000 Hectors, in spite of receiving the report, dated 09.05.2017, from the 6th respondent.

Heard Sri Mahadeva Kanthrigala, learned counsel appearing for the petitioner, learned Government Pleader for Mines and Geology appearing for respondents 1 to 4 and the learned Government Pleader for Revenue appearing for respondents 5 & 6. Perused the material available on record.

Learned Government Pleader for Mines and Geology appearing for respondents 1 to 4, on instructions, would submit that on 28.10.2017 itself, the Assistant Director of Mines and Geology, Palamaner, had submitted rejected proposals on Quarry Lease application filed by the petitioner at the subject area to the Deputy Director of Mines & Geology, Kadapa, under single file system on 28.10.2017 in File No.1046/Q1/RMBS/2017 as the petitioner has not paid the difference of application fee and deposit amount and also not attended for survey and inspection and further submitted that the applied area consists of Colour Granite cluster area and also is more valuable mineral than the applied

CKR, J W.P.No.44787 of 2017 mineral of Road Metal & Building Stone and, hence, the application for Road Metal & Building Stone is liable for rejection. Learned Government Pleader would further submit that in view of the above instructions, necessary orders would be passed. 4.

In the light of the submission of the learned Government Pleader for Mines and Geology appearing for respondents 1 to 4, the Writ Petition is disposed of directing the 2nd respondent to communicate the decision taken to the petitioner within a period of two (02) weeks from the date of receipt of a copy of this order.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.

There shall be no order as to costs.
