2/3 The learned counsel for the applicants upon instructions makes a categorical statement in the form of an undertaking that the applicants shall deposit an amount of Rs.24,00,000/- through demand drafts in favour of the Registrar, High Court, Bombay in the present matters. The Registrar to accept said DDs and further release amount in favour of the Investigating Officer of the present case.
The applicants are seeking regular bail in Crime No. 21 of 2016, registered at D.B. Marg Police Station, punishable under Sections 406 and 420 read with 34 Indian Penal Code. The investigation in the matter is already complete and the charge-sheet is filed.
In absence of criminal antecedents and as the applicants shown their bonafide by depositing the amount, in my opinion, no purpose would be served in detaining the applicants in Jail.
In view thereof, in my opinion, the applications need to be allowed. The applicants be released on bail on furnishing P.R. bond of Rs.25,000/- (Rupees Twenty Five Thousand only) with one or two sureties in the like amount.
3/3 Any two consecutive absence of the applicants before the learned trial court will entail the learned Judge to take out proceedings for cancellation of bail. The applicants not to tamper with the evidence and/ or influence the witnesses in any manner whatsoever. In view of disposal of Bail Application No.1794 of 2016, the Criminal Application No.814 of 2016 does not survive, the same is accordingly disposed off.
