DATE : 20th December, 2013 P.C. :- 1] Heard learned counsel for the applicant. Also heard learned APP for the State.

2] This is the application for bail in the matter of offences punishable under Sections 364-A, 385, 506 read with Section 34 of the Indian Penal Code.

3] The only allegation against the present applicant is that on 22nd August, 2013 when the complainant was present at the site of his construction work, present applicant approached and handed over him one mobile phone and asked him to talk to one co-accused by name Lodhubhai. Thereafter there was a conversation between

2/3 said Lodhubhai and the complainant in which according to complainant, said Lodhubhai had demanded ransom of Rs.50,000/- for giving protection to the construction work of the complainant. Apparently, said co-accused Lodhubhai is history sheeter in the same area of Dharkhadi, Dahisar (E). This is the only role assigned to the present applicant as to giving the mobile handset to the complainant and asking him to talk to co-accused. Thereafter on the night between 24th and 25th August, 2013 some unknown persons had demolished the construction done by the complainant. Then also one another unknown person approached the complainant and gave of mobile handset and asked him to talk to Lodhubhai. However, this later part of the episode is not concerning the role of the present applicant.

4] During the arguments, learned APP for the State submitted that there are statements of three other witnesses but they are in consonance with what is mentioned by the first informant in the complaint. Also there are no criminal antecedents against the present applicant. Considering this factual position, it is not necessary that the present applicant shall continue in custody and hence he can be released on bail on certain conditions. Hence the order:-

(i) Criminal Bail Application No.1785 of 2013 is allowed.

(ii) The applicant shall be released on bail on his executing P.R. Bond in the sum of Rs.20,000/- (Rupees Twenty Thousand) with one surety or two sureties for the like amount.

(iii) With this direction, present application is disposed of.
