sas
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CRIMINAL APPELLATE JURISDICTION CRIMINAL APPLICATION NO.673 OF 2013 Sunil Kashinath Chikane ..Applicant.
V/s.
The State of Maharashtra ..Respondent.
Mr. Ashok Kumar Dubey for the applicant.
Mrs. A.A. Mane, A.P.P. for the State.
CORAM :
P.N. DESHMUKH, J.
(VACATION COURT) DATED : 26TH DECEMBER, 2013 P.C. :- 1.
Heard learned counsel for the applicant. This production was allowed as it was orally submitted by the counsel for the applicant that the applicant's presence is necessary for attending the marriage of his brother's sister at Ulhasnagar. It appears that the applicant is released on bail by this Court by its order dated 7th January, 2013, however, on considering the criminal antecedents of the applicant, he is restrained from entering into the jurisdiction of Ulhasnagar police station. It further appears that thereafter, an application was moved by 1/3
the applicant for modification of the condition before this Court but it was rejected.
2.
It is noted that in the prayer clause of this application, no any relief is prayed for to attend the marriage of his brother's daughter, though orally submitted that the marriage is on 28th December, 2013. Learned counsel for the applicant though has stated that there is a reference about said fact in the body of the application. Para 6 of the application reveals thus "The applicant hereby further contends that there is a marriage program of applicant's brother daughter and all are residing together jointly, and in such type of program the presence of family members are essential and required."
3.
Having considered above facts, application is liable to be rejected as even otherwise, while enlarging the applicant on bail, he is restrained from entering the jurisdiction of Ulhasnagar police station. 4.
The application is, therefore, devoid of any merits and is rejected.
