1) The applicant is seeking bail in CR No.387/2015 dated 11.8.2015 registered with Goregaon Police Station, Mumbai under section 370 (3) of the I.P.C. and section 4 and 5 of the PITA Act. The record discloses that the first information report dated 11.8.2015 was lodged by Mr. Ramesh Avhad attached to Social Service Branch Mumbai. The Investigating agency received specific information that the applicant is indulging in the vocation of prostitution and acts as an agent. The applicant was having a specific

2 /3 mobile phone number. In pursuance of the said information, the investigating agency conducted a raid at a hotel by name Ratna Refreshment, at S.V .Road, Goregaon, Mumbai. At the time of conducting the said raid two victims ladies were found on the spot. The applicant was also present at the said spot. After completion of investigation, the police have filed the charge sheet.

3) Perused the statement dated 11.8.2015 of the victims ladies who are undisputedly major in age. They have stated that they were indulging in their vocation at their own will and the applicant was acting as an agent in the said trade. The learned APP. on instructions submitted that there are no antecedents at the discredit of the applicant. In view of the above, applicant has made out a case for his release on bail.

Hence, the order.

ORDER

a) The applicant shall be released on bail in CR No. I-387-201 registered with Goregaon Police Station, Mumbai on his furnishing PR bond of Rs..25,000/- with one or two solvent sureties in the like amount.

b) The applicant shall attend the Goregaon Police Station on every first Monday of the month

3 /3 between 10.00 a.m. to 12.00 noon till the conclusion of the trial.

c) The applicant shall not tamper with the prosecution witnesses and/or influence the prosecution witnesses.

d) Application is allowed in the aforesaid terms. (A.S.GADKARI, J.)
