This is a petition under Article 226 of the Constitution of India for issuance of a writ of habeas corpus. The petitioner contends that he was married to the first respondent - Rinka Omprakash Giri. Pursuant to the notice issued by us, the detenue i.e. respondent no.1 has been produced before us. In the presence of the learned APP, learned counsel for the petitioner and the respondent no.4, who appears in person, statement of

cri-wp-4768-14 Rinka was recorded in our chamber. The detenue - respondent no.1 Rinka in her statement has clearly stated that though she was married to the petitioner, she wishes to reside with her parents and has not been detained by anyone. In the light of the said statement, therefore, learned counsel for the petitioner seeks to withdraw this petition. 2.

Accordingly, this writ petition is dismissed as withdrawn with no order as to costs.
