Issue notice. Learned APP appears waiving service of notice on behalf of Respondent-State. Heard finally by consent of parties.

The applicant charge-sheeted by Indapur police station, Pune vide C.R. No. 241 of 2013 for the offences punishable under Sections 461, 380 and 411 read with 34 of Indian Penal Code prays for bail. The applicant is accordingly charge-sheeted 1/3
by the said police station on the accusation of himself in furtherance of common intention with charge-sheeted accused No.1 had stolen the motor of mill and weights from the tin shed of first informant and sold it to charge-sheeted accused No.3.

The applicant was arrested on 06-08-2013.
The investigation is complete and charge-sheet is filed. The offences for which the accused is charge sheeted are not even punishable with imprisonment for life. Considering the reasons for which the application was rejected by the Court of Session, and care about the said reasons can be taken by imposing appropriate conditions, the application is allowed.

The applicant is directed to be released on bail upon furnishing P.R. Bond in sum of Rs. 30,000/- with two sureties in like amount and 2/3
subject to the conditions of the applicants, (i) staying at the address mentioned in the application.
(ii) attending the investigating officer every Monday in between 11.00 am to 1.00 pm until further order.
(iii) not indulging in any activity of tampering the prosecution evidence and/or not indulging in any activity of coercing, threatening and pressuring the prosecution witnesses AND (iv) not misusing the protection granted by this order for fleeing away or for any other oblique purpose.
Application stands disposed of.
