The applicant is seeking regular bail in C.R.No. 399/2016 registered with Powai Police Station, Mumbai for the offence under section 370 (3)read with section 34 of IPC and under sections 3, 4 and 5 of the Immoral Traffic (Prevention)Act, 1956 on the ground of parity claimed with that of the main accused Sangeeta who is already ordered to be released on bail on 9 th December, 2016 in B.A.No.2476 of 2016.

2 921-BA-2592-16.docantecedents. In view thereof, in my opinion, further detention of the applicant is not warranted. Thus a case for bail is made out. Hence, the following order:- (i) The applicant in C.R.No. 399 of 2016 registered with Powai Police Station, Mumbai, for the offences punishable under Sections 370 (3) read with section 34 of the IPC, shall be released on bail on his executing PR Bond in the sum of Rs.50,000/- with one or two sureties in the like amount.

(ii) The applicant shall not tamper with the prosecution evidence and/or influence the witnesses. Two consecutive defaults before the learned Court below, undoubtedly the said Court to take out proceedings for cancellation of bail. (iii) The application is disposed of in the above terms. (N. W.
