Contention is after having obtained approval for development of Slum Rehabilitation project in Vikhroli (E) developer has commenced work in Vikhroli (W). We therefore wanted to find out area of slum of Petitioner. Learned Counsel disclosed that it is 15 x 30 ft i.e. 450 sq.ft. He also explains Nesarikar

2 / 2 63-WP-615-18.odt rehabilitation project is coming up in Vikhroli (W) on about 2000 sq.mtrs. Area. It is therefore apparent that other adjacent slum dwellers have not objected to the project. 2.

From narration of events by learned counsel it appears that this Court had permitted him to go to high power committee to establish his eligibility for consideration. It is not very clear whether High Power Committee has found any eligible slum dweller or not.

Contention that approval given for project in Vikhroli (E) has been tampered with and used for Vikhroli (W) is not being substantiated through material and also otherwise. 4.

We therefore find that no case is made out. Petition is therefore rejected.
