VERSUS
THE STATE OF MAHARASHTRA AND ANOTHER ...
Advocate for Petitioner : Mr. Chapalgaonkar Shailesh S. AGP for Respondent No.1: Mr. K. J. Ghute Patil. Advocate for Respondent No.2: Mr. S. T. Shelke. ...
CORAM: SUNIL P. DESHMUKH, J.
DATED:
21st DECEMBER, 2013.
PER COURT:
1.
A contempt of order dated 7 th June, 2013 in Writ Petition No. 386 of 2013 is sought to be imputed against the Respondents, particularly respondent No.2 contending that despite status-quo order, original petitioner was not allowed to resume duty on his original place before the transfer. 2.
Learned counsel Mr. Shelke appearing for Respondent
-:(2):- No.2 points out that the petitioner was relieved on 31 st May, 2013 that was before the order had been passed by this court. Learned counsel states that pursuant to subsequent order of Division Bench of this Court, the case of petitioner has been considered in his favour and as such the contempt petitioner has resumed duty accordingly.
3.
In view of aforesaid, there does not appear any willful disobedience of the order passed on 7 th June, 2013 and as such contempt of order can hardly be imputed to the Respondents. Contempt Petition, therefore, does not survive and is rejected as such.
