I have perused the applications.

By way of the application the appellant/State is seeking condonation of delay of 321 days for filing an application for setting aside abatement and also seeking setting aside abatement and permitting the State to bring legal representatives of respondents on record. For the reasons stated in paragraph No. 4 of the Civil Application No. 957/2021, the delay of 321 days is condoned.

The abatement is set aside.
