1. Respondent no. 1, who is the original claimant, has agreed to settle the matter by accepting total compensation of Rs.3,75,000/-, inclusive of no fault liability. As such, out of the total amount deposited, the respondent no. 1 is entitled to withdraw an amount of Rs.3,50,000/-, since the balance amount of Rs.25,000/- was deposited by the appellant, under Section 140 of the M.V. Act, 1988 and the same has been withdrawn by the respondent no. 1. The balance amount deposited in this Court by the appellant along with interest, if any, shall be paid to the appellant.

2. Consent terms duly signed by the parties are taken on record and marked 'X' for identification.

3. Respondent no. 1 is present and is identified by Advocate Susan Linhares.
