Respondents Prayer: Writ Petition has been filed under Article 226 of Constitution of India, to issue Writ of Mandamus, directing the respondent Nos.1 to 5 to remove encroachment made by the Respondent Nos.6 and 7 in public road comprised in Old Survey No.175/5, New Survey No.128/2, Konamangalam Village, Thaludali Post, Tindivanam Taluk, Villupuram, which is classified as Government Poramboke and later classified as "Public Road/Public Street" thereby consider the common representation dated 27.10.2025 submitted by the petitioner and general public in the village thereby enabling the petitioner and other General Public can use the land as "Public Road/ Public Street" without any hindrance.

(Order of the Court was made by G.Jayachandran J.) This Writ Petition has been filed seeking the issuance of a Writ of Mandamus, directing the respondent Nos.1 to 5 to remove encroachments made by the Respondent Nos.6 and 7 on the public road comprised in Old Survey No.175/5, New Survey No.128/2, Konamangalam Village, Thaludali Post, Tindivanam Taluk, Villupuram. The said is classified as Government Poramboke and later classified as "Public Road/Public Street". The petitioner further seeks a direction to consider the joint representation dated 27.10.2025 submitted by the petitioner and the village public, thereby ensuring unhindered public access to the road.

The learned Government Advocate, appearing for the respondents 1 to 5 submits that the encroachment pointed out in the writ petition has been identified and notice under Section 7 of the Tamil Nadu Land Encroachment Act, 1905, has already been issued to the 6th respondent, who is the alleged encroacher and necessary action for the removal of encroachment will be taken in accordance with law.

In view of the submission that the official respondents have already set the law in motion for the removal of the encroachment based on the petitioner's representation dated 27.10.2025, this Writ Petition stands closed with a direction to the respondents 1 to 5 to proceed with the eviction proceedings initiated on 12.06.2026 and pass appropriate orders on merits and in accordance with law. No costs.
