2. The learned counsel appearing for the applicant would submit that the notice sent to the respondent had been returned with an endorsement that the recipient is deceased.

3. In such view of the matter, this Court is of the view that the present application can be closed with liberty to the applicant to take out a fresh application to implead the legal heirs of the deceased on record.
