Prayer : Criminal Miscellaneous Petition filed under Section 482 of Cr.P.C/528 of BNSS, to modify the condition that "7. Accordingly, the appellant is ordered to be released on bail on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties (one must be a blood surety), each for a like sum to the satisfaction of the learned Special Court for Trial of Cases Under SC/ST (POA) Act, Namakkal....." imposed in the order dated 11.02.2026 made in Crl.A.No.88 of 2026 on the file of this Court. ORDER

This Court, by an order dated 11.02.2026 in Crl.A.No.88 of 2026, has granted bail to the appellant, inter alia, on the following condition: "7. Accordingly, the appellant is ordered to be released on bail on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties (one must be a blood surety), each for a like sum to the satisfaction of the learned Special Court for Trial of Cases Under SC/ST (POA) Act, Namakkal....."

2. The petitioner/appellant seeks modification of the said condition on the ground that his father, who is the only relative, is unable to walk and, in spite of the order of this Court, he is yet to execute sureties and therefore is still in confinement.

3. Heard the learned Counsel for Government of Tamil Nadu for the respondent.

4. Considering the averments made in the petition and the fact that the petitioner is still in custody, unable to execute sureties as directed, this Court modifies the condition in para 7 of the order dated 11.02.2026 in Crl.A.No.88 of 2026, as follows:

"7. Accordingly, the appellant is ordered to be released on bail on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties, each for a like sum to the satisfaction of the learned Special Court for Trial of Cases Under SC/ST (POA) Act, Namakkal....."

5. In other words, the requirement to produce a surety who is a blood relative is dispensed with.
