Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the respondents to consider the representation dated 07.01.2019 sent by the petitioner.

O R D E R

This writ petition has been filed for issuance of writ of mandamus directing the respondents to consider the representation made by the petitioner and pass orders within a time limit that may be fixed by this Court.

2.It is the case of the petitioner that he was appointed as Secondary Grade Teacher in the year 1971 and was awarded

Selection Grade pay in the year 1979 on completion of 10 years of service. The petitioner attained the Special Grade in the post of Tamil Teacher on the completion of 20 years of service. Ultimately, the petitioner retired from service on 31.05.2003, when he was working at 4th respondent School. The claim made by the petitioner is that the Secondary Grade Teacher employed in high school is also eligible for the scale of pay on par with the scale of pay with the promotional post of Primary School Headmaster. The petitioner in order to substantiate the said claim has placed reliance upon the earlier orders by this Court in the writ petition and writ appeal. The further claim of the petitioner is that the respondent has passed G.O.Ms.No.216, dated 23.03.

1993 and the petitioner has made a representation to the 1st respondent for extending the benefits of the said Government order. Since, the same has not been considered, the present writ petition has been filed before this Court. 3.Heard Mr.G.Pugazhenthi, learned counsel appearing on behalf of the petitioner and Mrs.V.Annalakshmi, learned Standing Counsel appearing on behalf of the respondents. 4.Taking into consideration the facts and circumstances of the case and also the limited relief that has been sought for in the present writ petition, there shall be a direction to the 1st respondent to consider the representation made by the petitioner dated 07.01.2019 and pass appropriate orders on its own merits and in accordance with law, within a period of eight weeks from the date of receipt of copy of this order.

The petitioner is directed to make a fresh representation to the 1st respondent along with earlier representation dated 07.01.2019 and also a copy of this order.

5.This writ petition is disposed of with the above directions. No Costs.
