This petition has been filed seeking to condone the delay of 33 days in filing the Civil Miscellaneous Appeal.

Mr.M.Krishnamoorthy, the learned counsel who appeared on behalf of the second respondent, stated that he has no objection to this petition being allowed.

Though notice has been served on the first respondent and his name is printed in the cause list, there is no representation on his behalf.

The reasons adduced in the affidavit filed in support of this petition being satisfactory, this Civil Miscellaneous Petition is ordered and consequently, the delay of 33 days in filing the appeal is condoned.
