IN THE HIGH COURT OF JUDICATURE AT MADRAS
DATED: 26-12-2025
CORAM
THE HONOURABLE MR JUSTICE S. M. SUBRAMANIAM
1. P.Gunaseeli Petitioner(s) Vs
1. D.Vigneshkumar alias Johnson Respondent(s) PRAYER To direct the Principal District Judge, Tiruvallur Court below to dispose of I.D.O.P.No.278 of 2024 on a priority basis within a stipulated time frame. For Petitioner(s):
Mrs.Kalai Selvi for Mr.P. Dinesh Kumar
ORDER
The present Civil Revision Petition has been instituted to direct the Principal District Judge, Tiruvallur to dispose of I.D.O.P.No.278 of 2024 on priority basis.
2. Direction, as such sought for cannot be considered, in view of the fact that there may be numerous cases, which all are pending before the Court for disposal. It is for the Presiding Officer concerned to dispose of the cases on his/her Board considering various factors. Therefore, High Court, issuing a direction for speedy disposal would cause inconvenience to the Judicial Officer for effective functioning and disposal of cases.
3. Routine directions issued by High Court to dispose of the cases, undoubtedly would cause inconvenience to the Presiding Officers of the Court. It may be practically impossible, since the other side may seek unnecessary adjournments or may file interlocutory applications with an idea to prolong or protract the proceedings. Therefore, it is for the Presiding Officer concerned to take decisions and dispose of cases in the manner known to law. Routine directions by the High Court in this regard would result in causing prejudice to the functioning of the District Courts and that being the position, the Civil Revision Petition deserves no merit consideration. However, petitioner is at liberty to make a request before the Court concerned for speedy disposal of the case.
4. Accordingly, the Civil Revision Petition is dismissed. No costs. 26-12-2025 gd Index:Yes/No Speaking/Non-speaking order
