ORDER : The Court Made the following order :- The petitioner, who is arrayed as A1 and he was arrested and remanded to judicial custody on 25.09.2014 for the alleged offence punishable under section 399 of IPC in Crime No.396 of 2014, on the file of the respondent police and hence, seeks bail. 2.The case of the prosecution is that on 25.09.2014. the petitioner along with with other accused were making preparation to commit robbery. 3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He further submitted that A3 and A4 were granted bail by this court in Crl.O.P(MD)No.20429 of 2014, dated 20.11.2014 and A2 was granted anticipatory bail by the Sessions Court, Thoothukudi in Cr.M.P.NO.2880 of 2014, dated 06.11.2014 and the petitioner is in jail for more than 80 days.

4.The learned Government Advocate (Criminal side) appearing for the respondent submitted that the investigation has been completed and the https://hcservices.ecourts.gov.in/hcservices/ charge sheet is yet to be filed and the petitioner is having five previous cases and in all cases, he is on bail.

5.Considering the facts and circumstances of the case and also considering the fact that the petitioner is in jail for more than 80 days and the investigation has been completed and the co-accused were enlarge on bail, this court is inclined to enlarge the petitioner on bail with certain conditions.

6.Accordingly, the petitioner is ordered to be released on bail, on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) along with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.II, Thoothukudi and on further condition that the petitioner shall appear before the respondent police daily at 10.30 a.m. and 05.00 p.m. until further orders. sd/- 16/12/2014 / TRUE COPY / Sub-Assistant Registrar (C.S.)
