ORDER : The Court Made the following order :- The petitioner prays for the grant of anticipatory bail under Section 438 of Cr.P.C. for the alleged offences punishable under Sections 147, 148, 323 and 324 of IPC and Section 3 of PPDL Act, in Crime No.249/2014, on the file of the respondent police.

2. The case of the prosecution is that on 25.11.2014, the de-facto complainant lodged a complaint before the respondent Police stating that on 29.10.2014, at about 5.00 p.m., the petitioner along with six others of Mustakurichi Village pelted stones on the front glass of the TNSTC Bus, as a result, the glass was broken.

3. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) for the respondent.

4. Considering the facts and circumstances of the case, this Court is of the view that the petitioner can be granted the relief prayed for subject to the following conditions;

(a) In the event of arrest by or on appearance before the respondent police;

(b) In the event of appearance before the learned Judicial Magistrate, Kamudhi; within 15 days from the date of receipt of copy of the order, (i)The petitioner shall deposit a sum of Rs.5,000/- (Rupees Five Thousand only) to the credit of Cr.No.249 of 2014 before the learned Judicial Magistrate, Kamudhi;

(ii) On such deposit being made, the petitioner shall be enlarged on bail on his executing a bond for Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for the like sum to their satisfaction; (iii) The petitioner shall report before the respondent police daily twice i.e., at 10.30 a.m. and 05.30 p.m until further orders. sd/- 30/12/2014 / TRUE COPY / Sub-Assistant Registrar (C.S.)
