PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, calling for the entire records pertaining to quash the impugned order passed by the second respondent in Na.Ka.No.3493/2026/H1 dated 06.06.2026 and consecutively direct the second respondent to correct the petitioner's father's death certificate in registration No.D-2026:33-15922-000042 dated 08.05.2026 in the column of husband / wife as Ramathal instead of Vellaiyammal by considering the Section 15 of the Registration of Births and Deaths Act, 1969, within a time stipulated by this Court.

The present Writ Petition has been filed seeking to quash the impugned order passed by the second respondent in Na.Ka.No. 3493/2026/H1 dated 06.06.2026 and for a consequential direction to the second respondent to correct the petitioner's father's death certificate in registration No.D-2026:33-15922-000042 dated 08.05.2026 in the column of husband / wife as Ramathal instead of Vellaiyammal by considering Section 15 of the Registration of Births and Deaths Act, 1969.
2.Learned Counsel appearing for the petitioner would submit that the petitioner is the son of Perumal Thevar. He died on 16.04.2026. Subsequently, one Muniappa, who is son of the second wife of the petitioner's father made application for issuance of death certificate in which the petitioner's mother's own sister is mentioned as wife. Aggrieved by the same, the present Writ Petition is filed. However, learned Counsel for the petitioner now prays that this Court may grant liberty to the petitioner to approach the Civil Court for appropriate remedy. 3.In view of the above submission made by the learned Counsel for the petitioner, this Writ Petition is dismissed with liberty to the petitioner to approach the Civil Court for appropriate remedy. However, the present Death Certificate shall be subject to the result of the civil suit to be filed by the petitioner. There shall be no order as to costs. 02.07.2026 NCC :
