PRAYER :- C-32B. To enlarge the petitioner on bail in connection with the case in C.C.No.315 of 2025 on the file of Learned Additional District and Sessions Court for EC and NDPS Act Cases, Pudukottai, Pudukkottai District and thus render justice.

ORDER : The Court made the following order :- The petitioner/A2, who was arrested and remanded to judicial custody on 17.06.2025 for the alleged offence under Sections 8(c) r/w 20(b)(ii)(C), 25 and 29(1) of NDPS Act, 1985, in C.C.No.315 of 2025 on the file of the Additional District Judge Special Court Under EC and NDPS court at Pudukkottai, in connection with the Crime No.52 of 2025 on the file of the respondent police, seeks bail.

2. The allegation in the complaint is that on prior information, on 07.06.2026, at about 04.45 hours, the Police party intercepted A1 to A6 near MTR fish company at Rameshwaram Ford. After intercepting A1 to A6, who were gathered along with a car and vehicle. After compliance of mandatory provisions, 50 kgs of Ganja were recovered from them and hence, the case was registered and the petitioner was arrested on 2/7

17.06.2025.

3.The learned counsel appearing for the petitioner submitted that this Court already granted bail to the co-acused namely, A1, A3 to A6 in Crl.O.P.(MD).Nos.11773 of 2026, 11501 of 2026, 8611 of 2026, 10715 of 2026 and 11335 of 2026 vide orders dated 01.07.2026 and 22.06.2026. He would further submit that the very same grounds are applicable to the petitioner herein. Hence, the petitioner is entitled to bail.

4. The learned Counsel for State of TN (Criminal Side) appearing for the respondent police reiterated the prosecution case and reported that the petitioner is ranked as A2 and the trial is progressing. Hence, he opposed to grant bail to the petitioner.

5. I have considered the submissions made on either side and perused the materials available on record.

6. Considering the rival submissions made by the learned counsel 3/7

on either side and the nature of offences levelled against the petitioner and considering the fact that this Court have already granted bail to the other accused including A1 in Crl.O.P.(MD).Nos.11773 of 2026, 11501 of 2026, 8611 of 2026, 10715 of 2026 and 11335 of 2026 vide orders dated 01.07.2026 and 22.06.2026, since the other accused granted bail based on the grounds raised and, the petitioner is also entitled to benefit of the very same ground, I am inclined to grant bail to the petitioner subject to the following conditions:

[a] Accordingly, this petition is ordered and the petitioner is ordered to be released on bail on condition to execute a bond for a sum of Rs.15,000/- (Rupees Fifteen Thousand only) with two sureties each for a like sum to the satisfaction of the learned Special District and Sessions Court NDPS Act Cases, Pudhukottai, Pudukottai District, and on further conditions that:

[b] the petitioner shall report before the trial Court on all working days at 10.30 a.m., for a period of four weeks.

[c] the petitioner shall not commit any offence similar to the offence of which she is accused, or suspected, or of the commission of which she is suspected;

[d] the petitioner shall not abscond either during investigation or trial;

[e] the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade her from disclosing such facts to the Court or to any police officer or tamper with the evidence;

[f] On breach of any of the aforesaid conditions, the learned Judicial Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].

[g] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 BNS.
