ORDER

Challenging the order passed by the 1st respondent dated 02.06.2026, granting 21 days of ordinary leave to the petitioner's husband / convict prisoner with escort, this writ petition is filed to quash the same, with a consequential direction to the respondents to grant such ordinary leave without escort.

The learned counsel for the petitioner would submit that since the convict prisoner has to raise funds for the medical expenses of his mother and that the family is also in financial constraints, he will be burdened with escort expenses and it would cause hardship to the family. Therefore, the learned counsel would pray for setting aside the condition in the impugned order with regard to the escort during the leave period.

Taking into consideration the exceptional circumstances under which the leave is sought for to the convict prisoner which is to raise funds for his mother's medical expenses, we are inclined to modify the impugned order to the effect that the convict prisoner shall be granted ordinary leave for 21 days without escort, on the following conditions: (i) The convict prisoner namely, Marjuck Alighan, S/o.Rukkun Batcha, Life Convict, PID No.419256, now detained in the Central Prison, Trichy, is granted ordinary leave for 21 days from 05.07.2026 to 26.07.2026, without escort. (ii) The convict prisoner shall execute sureties before the Jail authorities concerned.

(iii) The convict prisoner shall be released from the Prison at 5.00 p.m on 04.07.2027 and he shall return back to the Prison at 10.00 a.m on 27.07.2026. (iv) During the said leave period, the convict prisoner shall report before the Inspector of Police, Koradacheri Police Station, Tiruvarur District, daily at 06.00

p.m., from 05.07.2026 onwards without fail.

(v) During the leave period, the convict prisoner shall abide by all the conditions prescribed in the Jail Manual.
