PRAYER :- For Bail in Crime No.383 of 2021 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/Accused No.1 herein, who was arrested on 14.12.2021 for the alleged offence under Sections 379 IPC and 21(1) Mines and Minerals Development and Regulation Act, in Crime No.383 of 2021, on the file of the respondent police, seeks bail. 2.The case of the prosecution is that when the respondent police were on patrolling duty, they intercepted and seized the vehicle bearing Registration No.TN 74 AK 4899, which carrying 3⁄4 unit of sand. Hence, the case.

3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution.

4.The learned Government Advocate (Crl. side) submitted that there are two previous cases against the petitioner, similar in nature, in Crime No.383 fo 2021 and 347 of 2020 and one previous case in Crime No.367 of 2021 for other IPC offences. https://hcservices.ecourts.gov.in/hcservices/ 1/2

5. Since the petitioner is having two previous cases similar in nature, this Court is not inclined to grant bail. Accordingly, this criminal original petition is dismissed.
