For Respondent : Mr.S.S.Madhavan, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.566 of 2021 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioners/Accused, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 379, 427, 406, 407, 415, 420, 120(b) IPC, in Crime No.566 of 2021, seek anticipatory bail.
2.The case of the prosecution is that the first accused conspired with the other accused persons, criminally trespassed into the defacto complainant's house and stolen 60 sovereign of jewels of the defacto complainant. Hence, the complaint. 3.The learned counsel for the petitioners would submit that the petitioners are innocent and not committed any offence as alleged by the prosecution. They have no previous case at their credit. Hence, prays to release them on anticipatory bail.

4.The learned Government Advocate (Crl.Side) appearing for the respondent would submit that the defacto complainant came to know about the occurrence, only after receipt of auction sale notice and lodged a complaint. The investigation is not yet completed. 5.Considering the facts and circumstances of the case, that the nature of charges levelled against the petitioners in the alleged crime and serious nature of offence, this Court is not inclined to enlarge the petitioners on anticipatory bail, at the crucial stage of investigation.
