For Respondent : Mr.A.Robinson, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No. 85/2019 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioners apprehending arrest at the hands of the respondent police for the offences under sections 448, 324 and 506 (i) of I.P.C. and Section 4 of Tamilnadu Prohibition of Harassment of Women Act, in Crime No.85 of 2019, on the file of the respondent police, seek anticipatory bail.

2. The case of the prosecution is that the first petitioner's daughter and the defacto complainant's son got married. Their relationship came under strain. The defacto complainant's daughterin-law went to the house of the first petitioner. Hence, the petitioners went to the house of the defacto complainant and attacked her with bricks and abused her in filthy language.

3. The learned counsel appearing for the petitioners submitted that the petitioner did not commit any offence as alleged by the prosecution and due to family dispute, the defacto complainant foisted a false complaint.

4. The learned Government Advocate (Crl. Side) submitted that the the victim has been discharged from the hospital.

5. Recording the same, I am inclined to grant anticipatory bail to the petitioners with certain conditions. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate, Singampunari, and on their executing a bond for a sum of Rs.10,000/- (Rupees Ten thousand only) each with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioners shall appear before the respondent police daily at 10.00 am until further order. The petitioners shall comply with the conditions stipulated under Section 438 Cr.P.C scrupulously.

6. The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
