ORDER : The Court Made the following order :- There are totally six accused and these petitioners are arrayed as A1 to A3 and they were arrested and remanded to judicial custody on 09.10.2013 by the respondent police for the alleged commission of offence under Sections 8(c) read with 20-(b)(ii)(c) of N.D.P.S. Act, in Crime No.369 of 2013 on the file of the respondent police, and seek bail. 2.The case of the prosecution is that on prior information, the respondent police mounted a vigilance and three persons were moving in suspicious manner and they were searched them and each of them was found carrying 20 kgs each of kanja in gunny bags.
3.The learned counsel appearing for the petitioners would submit that weight was made with gunny bags and therefore, it has been shown as if each of the petitioner has carried 20 kgs of kanja and actually, it is less than commercial quantity and Considering the period of incarceration and no antecedents on the part of the petitioners, he prays for bail.
4.The learned Government Advocate (criminal side) would submit that other accused are absconding and the contraband has been recovered and that the petitioners are not having antecedents. 5.This Court, taking into consideration of the above facts and circumstances of the case and considering the fact that the petitioners are not having antecedents, is inclined to enlarge the petitioners on bail with certain conditions. Accordingly, the petitioners are directed to be released on bail each of them on executing a personal bond each for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties each for a https://hcservices.ecourts.gov.in/hcservices/
like sum to the satisfaction of the learned Additional District Judge/Principal Special Court for E.C. and N.D.P.S. Act Cases, Madurai and on further condition that the petitioner shall appear before the respondent police daily at 11.00 a.m for a period of eight weeks and thereafter, as and when required.
