O R D E R
This is an application filed under Section 439 of the Code of Criminal Procedure.

When the petition came up for hearing, the learned counsel for the petitioner submitted before me that the petitioner is unnecessarily arrested by the Excise officials alleging that the petitioner was in possession of 600 M.l. of Indian made foreign liquor and it was intended for sale.

I heard the learned Public Prosecutor, who submitted before me that it is a case where the petitioner was selling Indian made foreign liquor without any authority or licence.

For possessing 3 litres of Indian made foreign liquor, no permit or license is necessary in our State. The allegation is that the petitioner indulged in sale of IMFL. It is a matter to be proved during trial.

After considering the totality of the case and the
B.A. No.8194 of 2015 quantity of the Indian made foreign liquor involved, I feel that the petitioner can be granted bail on the the following conditions:
1) The petitioner shall be released on bail on executing a bond for Rs.10,000/- (Rupees ten thousand only) with two solvent sureties each for the like amount to the satisfaction of the court concerned.
2) The petitioner shall appear before the Investigating Officer as and when required by notice in writing. 3) The petitioner shall not commit any offence during the bail period.
4) The petitioner shall co-operate with the investigation.
On the above conditions, this bail application is allowed.
