O R D E R
This is an application filed under Section 439 of the Code of Criminal Procedure by the first accused in crime No.1130/2015 of Kattoor Police Station.

When the petition came up for hearing, the learned counsel for the petitioner submitted before me that the petitioner is the accused in the above crime which is mainly registered for an offence under Section 326 r/w. Section 34 of IPC. It is the submission that the allegation is that the petitioner beat the defacto complainant with a stone and a tooth was lost by him. It is the submission that all other accused in the above crime are already released by the court below.

I heard the learned Public Prosecutor, who strongly opposed the bail application.

The learned Public Prosecutor submitted before me that overtact is attributed against this petitioner and he is arrested only on 8.12.2015 and only the first remand
period is over.

After going through the F.I. statement and the statement to the doctor, I feel that bail can be granted to the petitioner herein on the following conditions: 1) The petitioner shall be released on bail on his executing a bond for Rs.25,000/- (Rupees twenty five thousand only) with two solvent sureties each for the like sum to the satisfaction of the learned Magistrate having jurisdiction.
2) The petitioner shall appear before the Investigating Officer for interrogation on all Saturdays and Wednesdays between 10.00 a.m. and 11.00 a.m. till the charge sheet is filed.
3) The petitioner shall not intimidate or attempt to influence the witnesses, nor shall he tamper with the evidence.
4) The petitioner shall not involve in any other offence during the period of bail.
5) The petitioner shall co-operate with the
investigation.
In case of violation of any of the above conditions, the learned Magistrate is empowered to cancel the bail in accordance with law without referring the matter to this court.
