1. This is an application under Sec.439 Cr.P.C. for bail and the offences alleged are under Secs.376(1)/302/201, I.P.C.

2. Heard Mr. SA Hafiz, learned counsel for the Petitioner as well as Mr. K. Das, learned A.S.C. for the State-Opposite Party.

3. It is submitted on behalf of the Petitioner that he is inside custody since 21.9.2019 and in the meantime 15 witnesses have been examined in course of trial, but the trial is yet to complete.

4. Upon hearing Mr. K. Das, learned Additional Standing Counsel for the State-Opposite Party and considering the circumstances as well as the scientific examination report of the vaginal swab, I am not inclined to release the Petitioner on bail by deferring from earlier order of this Court dated 19.01.2021 passed in BLAPL No.1409 of 2020. Accordingly, the prayer for bail is rejected.

5. The BLAPL is dismissed.
