1. Considering that Civil Suit No.31 of 2001, in which the present Appellant is a Defendant, is still pending, the Court is not inclined to interfere with the impugned order of the learned Single Judge.

2. Nevertheless, it will be open to the Appellant to request the concerned trial Court for expeditious disposal of the aforementioned civil suit.

3. Accordingly, the writ appeal is dismissed with the above observations.
