This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard learned counsel for the petitioners and the learned counsel for the State.

This is an application under section 439 of Cr.P.C. in connection with G.R. Case No.489 of 2022 arising out of Basudebpur P.S. Case No.222 of 2022 pending in the Court of learned J.M.F.C., Basudebpur for alleged commission of offences punishable under sections 302/304-B/498-A/406/34 of the Indian Penal Code and section 4 of the D.P. Act.

The petitioners moved an application for bail

// 2 // before the Court of learned Sessions Judge, Bhadrak which was rejected on 17.11.2022.

In view of the dying declaration of the deceased, I am not inclined to release the petitioners on bail. Accordingly, the BLAPL stands dismissed.
