Lata Devi & ANR v. Manpreet Singh & ORS
2023:PHHC:074328 CR-7681-2018 (O&M)
IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH
CR-7681-2018 (O&M) Date of decision: May 22, 2023 Lata Devi and another ....Revisionists versus Manpreet Singh and others ....Respondents
CORAM:
HON'BLE MR. JUSTICE ARUN MONGA Present:- None for petitioners.
Mr. Sachin Gupta, Advocate for Mr. Sachin Ohri, Advocate for respondent No.3-Insurance Company. ***** ARUN MONGA, J. (ORAL) Petition herein inter alia is for setting aside impugned order dated 14.09.2018 (Annexure P-5) passed by learned Motor Accidents Claims Tribunal, Pathankot (for short 'Tribunal'), whereby application under Order VI Rule 17 of Code of Civil Procedure, 1908 (for short 'CPC') filed by respondent No.1 for amendment of written statement, was allowed.
2.
Petitioners are the claimants before learned Tribunal seeking compensation on account of the accident in question and have impugned order dated 14.09.2018 vide which amendment in the written statement of respondent No.1 was allowed. Notice of motion was issued way back on 14.11.2018 and further proceedings before learned Tribunal were stayed. When called out today, none appears on behalf of petitioners. Needless to say, interim order has already resulted in colossal delay which is to the detriment of the claimants and when called out for hearing today, none represents them which would result in further delay. 3.
In the premise, revision is dismissed for non-prosecution. Learned Tribunal to proceed further in accordance with law. 4.
Pending application(s), if any, shall also stand disposed of. (ARUN MONGA) JUDGE May 22, 2023 mahavir Whether speaking/reasoned:
