Mr. Vikas Chaudhary, Advocate, for the petitioner. TEJINDER SINGH DHINDSA J. (ORAL) The instant petition has been filed under Section 438 of the Code of Criminal Procedure, 1973, seeking concession of pre-arrest bail to the petitioner in FIR No.459 dated 28.07.2016 under Sections 376 and 328 of the Indian Penal Code, 1860, and under Sections 3, 33 and 89 of the Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act, 1989 registered at Police Station Palam, Gurgaon.
Learned counsel for the petitioner has been heard at length and the pleadings on record have been perused.
The direct allegations against the present petitioner are of having enticed the complainant/prosecutrix on the premise of getting a job and thereafter, having taken her to a hotel, forcibly committed sexual assault upon her.
In the light of such direct and serious allegations levelled against the petitioner, this Court is not inclined to give concession of prearrest bail to the petitioner. Accordingly, the petition is dismissed.
