The petitioner through instant petition under Articles 226/227 of Constitution of India is seeking setting aside of order dated 31.05.2016 (Annexure P-5) whereby 33 officers have been promoted and the petitioner was not called for interview.

It is admitted case of both sides that all the private respondents and the petitioner have retired on attaining the age of superannuation. 3.

As all the private respondents and petitioner have retired, it is too late to consider validity of promotion of 33 respondents. 4.

The claim of the petitioner is that he was within the zone of selection, however, he was not called for interview, resultantly, his right to be considered for promotion was violated.

Learned counsel for the respondents opposes prayer of the petitioner.

The matter is pending before this Court since 2016 and all the contesting parties have already retired. Without commenting upon merits of the case and to put the litigation to rest, this Court finds it appropriate to direct the respondents to pay a sum of Rs.50,000/- which shall not be considered as costs. The respondents now known as SBI shall pay said amount within one month from today.
