Petitioner seeks regular bail in case arising out of FIR No. 229 dated 29.11.2025 under Sections 109, 118(1), 115(2), 3(5) Bharatiya Nyaya Sanhita, 2023 and Section 25 of Arms Act, Police Station Raman Bathinda. Offence under Section 118(2) BNS was added in the FIR during investigation. This is the second petition for regular bail. First one was dismissed as withdraw on 12.03.2026.

Complainant Manveer Singh @ Marry reported that he had completed his studies and remained at home. His maternal grand parents and those of Manrpreet Singh son of Lakhwinder Singh were both residents of village Channo. His mother Sandeep Kaur and mother of Manpreet Singh, namely Jaswinder Kaur were best friends. On 28.11.2025, at 7.00 AM, Manpreet Singh came to his house at Channo in his Chevrolet Optra Car and asked him to accompany for sowing of wheat crop. At about 11 AM, they came to village Sekhu. He accompanied Manpreet Singh, Lakhwinder Singh

to the fields on their tractor and started sowing wheat. At about 12.00 Noon, Harbans Singh son of Gurdev Singh, armed with pistol, Daljeet Singh son of Gurdev armed with Kasiya and daughter of Harbans Singh, all residents of village Sekhu, Mahinder Singh son of Gurdev Singh and Raja Singh son of Mahinder Singh reached the spot. Harbans Singh fired a shot from his pistol proclaiming how they were sowing wheat crop in the fields. The shot hit the right side of his waist, on which account he fell on the ground. When Manpreet Singh tried to lift him, Daljeet Singh, Raja Singh and Mahinder Singh thrashed him up with their weapons. They also pushed Lakhwinder Singh. When they raised alarm, on seeing people gathering, they fled from the spot with their respective weapons. There was an ongoing dispute between Lakhwinder Singh and his brother Harbans Singh regrading the agricultural land, on which account, all of them arrived with the intention to kill them and caused them injuries. They were admitted in the Civil Hospital, Bathinda, from where they were referred to COSMO Hospital. 3.

Learned counsel for the petitioner submits that co-accused Raj Singh and Mahinder Singh had been allowed anticipatory bail by a Coordinate Bench of this Court. Allegations against the petitioner were not on worse footing. The FIR was delayed by one day and all members of the family had been implicated on account of the ongoing dispute over agricultural land. Petitioner had been falsely implicated in the case by manipulating facts and was attributed only simple injuries. It was a case of cross-version and petitioner himself suffered head injury. Cross-version of the petitioner was recorded only 03 days after the occurrence. He was in custody w.e.f. 12.12.2025. Investigation of the case was complete and trial

would take long to conclude. Petitioner, thus, deserved to be released on regular bail.

Co-accused namely Raj Singh and Mahinder Singh have since been allowed anticipatory bail by Co-ordinate Bench vide order dated 11.05.2026 in CRM-M-7835-2026. Petitioner has been attributed injury with Kasiya. There is no dangerous injury inflicted. He is in custody for the last 06 months and 08 days. Investigation of the case is complete. There is no reason to believe that petitioner would obstruct the course of justice or evade the trial. Antecedents of the petitioner are clean. He is not stated to be involved in any other case. Though the first petition for regular bail filed by the petitioner was dismissed as withdrawn on 12.03.2026, considering the period of incarceration undergone by him since then and the fact that no findings on merits were recorded, petition is allowed. Without a comment on merits of the case, petitioner is ordered to be released on regular bail subject to her furnishing adequate bail and surety bonds to the satisfaction of trial Court/Duty Magistrate (SHALINI SINGH NAGPAL) JUDGE
