Present third petition has bee en filed under Section 483 of BN NSS (439 Cr.P P.C.) for grant of interim b bail in NCB Crime No.4, da ated 07.02.202 25, under Sections 8, 8-A, 21,22 2, 23, 25, 26, 27-A, 27-B, 29 & & 60 of NDPS Act, 1985, registered at Police Station Narcotics Control Bure eau, Amritsar Zonal Unit, Amritsar, Punjab.

Learned counsel appearing for the petitioner, while rais sing submissio ons in tandem with the averme ents contained in the petition, has argued th at the petitioner may be afforded d the concession of interim bail for a limited period in order to enable him to o carry out the remaining last r ites related rit tuals of his deceased mother, wh ho has passed away on 27.06.20 026.
Learned counsel has further submitted d that the petitioner was ear rlier afforded interim regular bail for a per riod of 10 days vide order da ated 11.03.202 26 passed in CRM-M-12458-2
026. Learned Counsel has furt ther
submitted that the petitioner is willing to abide by the terms and conditions imposed upon him while being granted the said concession. 3.
In oppugnation, learned Special Public Prosecutor for NCB has opposed the grant of interim bail to the petitioner by iterating that there are other family member(s), who are competent to perform the remaining last rituals of the petitioner's mother. He has further iterated that the petitioner may also pose a flight risk, particularly keeping in view the seriousness and gravity of the allegations levelled against him in the present petition. It has been further contended that if the petitioner is released on interim bail, there exists a strong possibility that he may evade from the process of law. Furthermore, it has also been brought to the notice of this Court that another case registered by the NCB is pending against the petitioner.
Learned Public Prosecutor has, however, not denied the factum of the petitioner's mother having passed away on 27.06.2026, as also the factum of the petitioner having surrendered back to custody in time after availing the earlier 10 days interim regular bail. On the strength of aforesaid grounds as also the conduct and antecedents, it has been prayed that the petitioner is not entitled to the concession of interim bail.

I have heard learned counsel for the rival parties and have perused the available record.

Before proceeding further, it would be apposite to refer herein to the judgment passed by this Court in CRM CRM-M-33729 33729 33729 33729-2025 2025 titled as Jaswinder Singh alias Kala versus State of Punjab Jaswinder Singh alias Kala versus State of Punjab Jaswinder Singh alias Kala versus State of Punjab Jaswinder Singh alias Kala versus State of Punjab, decided on 21.07.2025, wherein it has been held as under:
"14. As a sequitur to above-said rumination, the following postulates emerge:
(I) (i) A bill plea on merits; in respect of an FIR under NDPS Act of 1985 involving offence(s) under Section 19 or Section 24 or Section 27-A thereof and for offence(s) involving commerical quantity; is essentially required to meet with the rigour(s) of Section 37 of NDPS Act.
(ii) The rigour(s) of Section 37 of NDPS Act do not apply to a bail plea(s) on medical ground(s), interim bail on account of any exigency including the reason of demise of a close family relative etc.

Without expressing any opinion on the merits of the case as also keeping in view the factum of the death of the petitioner's mother has not been disputed, this Court is inclined to afford the concession of interim regular bail to the petitioner from 04.07.2026 to 11.07.2026. 7.
Accordingly, the petition in hand is allowed. The petitioner is ordered to be released on interim regular bail from 04.07.2026 to 11.07.2026, albeit, subject to his furnishing bail bonds/surety bonds to the satisfaction of the concerned Chief Judicial Magistrate/Illaqa Magistrate/Duty Magistrate. However, in addition to condition(s) that may be imposed by the concerned CJM/Duty Magistrate, the petitioner shall remain bound by the following conditions:- (i) The petitioner shall not mis-use the liberty granted. (ii) The petitioner shall not tamper with any evidence, oral or documentary, during the trial.
(iii) The petitioner shall not absent himself on any date before the trial.
(iv) The petitioner shall not commit any offence while on bail. (v) The petitioner shall deposit his passport, if any, with the trial Court.
(vi) The petitioner shall give his cell-phone number to the Investigating Officer, keep it on all times & shall not change cell-
phone number without prior permission of the concerned trial Court.

The petitioner shall surrender back to the custody immediately after expiry of the aforesaid concession of interim bail from 04.07.2026 to 11.07.2026. In case of breach of any of the aforesaid conditions and/or those which may be imposed by concerned CJM/Duty Magistrate as directed hereinabove or upon showing any other sufficient cause, the NCB/complainant shall be at liberty to seek cancellation of interim bail granted to the petitioner.

Since the main case has been decided, pending application(s), if any, shall also stand disposed of.
