A statement has been made by learned counsel for the appellant that the sole appellant, Jagat Singh, has since expired. Despite his best efforts, the legal representatives of the deceased appellant have not come forward to be impleaded as parties to the present appeal. Learned counsel for the appellant submits that in such circumstances this appeal may be disposed of with liberty to get it revived as and when the legal representatives of the deceased appellant approach this Court.

In view of the aforesaid circumstances, the present appeal is dismissed in default with liberty as aforesaid.
