Case No :IA. 0000648/2015 Party Name : MALLIKA DATTA Vs THE STATE OF TRIPURA & ORS THE HONBLE MR. JUSTICE S.TALAPATRA Heard Ms. R. Purakayastha, learned counsel appearing for the petitioner and Mr. T. D. Majumder, learned G.A. appears for the respondents, This is a petition for interim order staying the T-TET examination to be held on 21.12.2015 or alternatively allowing the petitioner provisionally to appear in the said test. The brief case of the petitioner as projected in the writ petition is that the petitioner passed the one year Diploma course in the Teachers@@@@@ Training from the SCERT. By means of the impugned notice dated 02.11.

2015 published by the Teachers@@@@@ Recruitment Board Tripura(TRBT), it has been clearly stipulated that those applicants who have done one year Diploma in the Elementary Education from the NCTE recognised institution before 2005, will be considered as eligible for applying, else two years Diploma in Elementary Education will be essential. In the writ petition the setting up of cut of date has been challenged. Ms. R. Purakayastha, learned counsel appearing for the petitioner has submitted that the petitioner did not pass the one year Diploma in Elementary Education before 2005. She has only passed the said one year Diploma course in June, 2005. Her prayer is that either this examination process has to be stayed or she might be allowed to appear in the said examination subject to the result of the connected writ petition.

The interim order as sought from this court cannot be passed at this stage. If the interim order as sought for are permitted that would open floodgate and as such as an interim measure such order could not be passed. However, if the petitioner succeeds in the writ petition, she will be provided with the appropriate relief including consideration of her appointment from the date when the teachers will be appointed in terms of the said advertisement dated 02.11.2015 and if required, the relaxation of age shall also be considered at that point of time. Moreover, Mr. T. D. Majumder, learned G.A. has pointed out that the petitioner has approached this court belatedly as the last date of submission of the forms expired on 13.11.2015. Accordingly, this petition stands disposed of.
